From death penalties\u00a0for drug offenders in China to the bloody security crackdown\u00a0in the Philippines, which has claimed\u00a0<\/span><span class=\"Hyperlink0\"><span lang=\"EN-US\"><a href=\"https:\/\/drugarchive.ph\/post\/26-the-drug-killings-who-what-%25252520where-when-how-master\">27,000 lives<\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0so far, countries in the region continue fighting drugs with brutal measures.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Next month the UN\u00a0<\/span><\/span><span class=\"Hyperlink1\"><span lang=\"EN-US\"><a href=\"https:\/\/www.unodc.org\/unodc\/en\/commissions\/CND\/2019\/2019-high-level-ministerial-segment.html\"><span>Commission on Narcotic Drugs<\/span><\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0will convene in Vienna to evaluate progress on countering the drug problem across the world. When officials sit down for discussions, they should not shy away from asking the tough questions.\u00a0<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Has the war on drugs moved Asia any closer to achieving the elusive\u00a0drug-free\u00a0society? Has it effectively eliminated or significantly reduced illicit drug markets? And has it advanced\u00a0<\/span><\/span><span class=\"Hyperlink1\"><span lang=\"EN-US\"><a href=\"https:\/\/sustainabledevelopment.un.org\/?menu=1300\"><span>UN&#8217;s overarching goals<\/span><\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\"> of advancing health, human rights, public security and sustainable development?<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Recent research\u00a0<\/span><\/span><span class=\"Hyperlink0\"><span lang=\"EN-US\"><a href=\"https:\/\/idpc.net\/publications\/2019\/02\/10-years-of-drug-policy-in-asia-how-far-have-we-come-a-civil-society-shadow-report\">shows<\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0that the answer to these three questions is a resounding no. In fact, data demonstrates that\u00a0the war on drugs waged by countries across Asia has proven to be a devastating failure.\u00a0\u00a0<\/span><\/span><\/p>\n<h2 class=\"Body\"><span class=\"None\"><strong><span lang=\"EN-US\">Brutal policies are failing<\/span><\/strong><\/span><\/h2>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Current approaches to drug control in Asia overwhelmingly criminalise people already on the margins of society &#8211; those who use or are dependent on drugs &#8211; with dire consequences for them, their families and communities.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Among the harshest penalties imposed in the name of the &#8220;war on drugs&#8221; is the mandatory death penalty for drug trafficking. In the past decade,\u00a0more than 3,940 people\u00a0globally were\u00a0<\/span><\/span><span class=\"Hyperlink0\"><span lang=\"EN-US\"><a href=\"http:\/\/fileserver.idpc.net\/library\/Shadow_Report_FINAL_ENGLISH.pdf\">executed<\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0for drug offences. Half of all countries worldwide that impose capital punishment for drug crimes are in Asia.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Then there is the surge in extrajudicial killings of individuals accused and suspected of using or selling drugs, a grave human rights violation promoted by Philippine President Rodrigo Duterte, which now seems to be spreading across the region. During a visit to the Philippines earlier this month, Sri Lanka&#8217;s President\u00a0Maithripala Sirisena praised the country&#8217;s state-sanctioned massacre as &#8220;an example to the world&#8221; and\u00a0<\/span><\/span><span class=\"Hyperlink1\"><span lang=\"EN-US\"><a href=\"https:\/\/www.aljazeera.com\/news\/2019\/02\/sri-lanka-resume-executions-drug-convicts-sirisena-190207002940841.html\"><span>vowed<\/span><\/a><\/span><\/span><span class=\"Hyperlink2\"><span lang=\"EN-US\"><a href=\"https:\/\/www.aljazeera.com\/news\/2019\/02\/sri-lanka-resume-executions-drug-convicts-sirisena-190207002940841.html\">\u00a0<span class=\"Hyperlink0\"><span>to bring back the death penalty<\/span><\/span><\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0for drug offenders.\u00a0In May 2018, Bangladesh launched a Philippine-style &#8220;war on drugs&#8221; which resulted in more than 100 deaths and\u00a012,000 drug arrests\u00a0in its first 15 days.\u00a0<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Several countries in Asia, including\u00a0<\/span><\/span><span class=\"None\"><span lang=\"NL\">Brunei, Malaysia and Singapore,<\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0still condone caning, whipping, lashing or flogging for people accused of drug use, including children. Even if corporal punishment is banned, individuals\u00a0caught using drugs continue to be treated like criminals in many places across Asia.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Instead of being offered drug dependence\u00a0treatment, harm reduction, counselling and other psycho-social support services,\u00a0suspected drug users often face<\/span><\/span><span class=\"None\"><span lang=\"FR\">\u00a0<\/span><\/span><span class=\"None\"><span lang=\"EN-US\">forced urine testing, mandatory registration with law enforcement authorities, imprisonment and detention.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">In the Philippines, students\u00a0<\/span><\/span><span class=\"None\"><span lang=\"DE\">undergo<\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0mandatory drug testing at a great cost to an under-funded educational system.\u00a0Drug offenders\u00a0make up to 50-70 percent of total prison populations in Indonesia, Thailand and Myanmar,\u00a0clogging prisons that are already above capacity. In Thailand, a staggering\u00a080 percent of the 47,000 women in prison\u00a0<\/span><\/span><span class=\"None\"><span lang=\"IT\">are incarcerated on a drug offence,<\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0usually a non-violent one, like possession or personal use.<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">Not content with locking up people who use drugs in prisons, many governments also detain them\u00a0in the name of treatment and rehabilitation. In the 1990s China <a href=\"http:\/\/www5.austlii.edu.au\/au\/journals\/MurUEJL\/1999\/2.html\">launched<\/a> its &#8220;war on drugs&#8221; and opened such detention facilities to imprison drug users who were deemed threatening to national security or public order in order to &#8220;re-educate&#8221; them through forced labour.\u00a0<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">Despite being\u00a0widely condemned by\u00a0<\/span><\/span><span class=\"hyperlink10\"><span lang=\"ES-TRAD\"><a href=\"http:\/\/www.unaids.org\/en\/resources\/presscentre\/featurestories\/2012\/march\/20120308adetentioncenters\"><span>UN agencies<\/span><\/a><\/span><\/span><span class=\"none0\"><span lang=\"EN-US\">,\u00a0academics\u00a0and\u00a0<\/span><\/span><span class=\"hyperlink10\"><span><a href=\"https:\/\/www.hrw.org\/news\/2012\/07\/24\/drug-detention-centers-offer-torture-not-treatment\"><span lang=\"EN-US\">civil society<\/span><\/a><\/span><\/span><span class=\"none0\"><span lang=\"EN-US\">\u00a0for employing forced labour, torture and other abuses of human rights, such facilities remain prevalent in Cambodia, China, Laos, Malaysia, Myanmar, the Philippines, Singapore, Thailand, and Vietnam; as of 2014, 450,000 people were being held in such centres.\u00a0<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">Meanwhile, provision of effective, voluntary and evidence-based healthcare for drug users in Asia lags behind the rest of the world. Drug treatment quality is inconsistent. In India and Nepal, allegations of abuse, torture, death and lack of access to treatment for drug dependence at private drug treatment centres\u00a0abound.<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">On top of these various failures, politicians in the region have increasingly started using the drug problem for political gains. This has eroded democratic institutions, promoted corruption and normalised stigma and discrimination against people who use drugs. In the Philippines, for instance, the so-called &#8220;drug menace&#8221; has been invoked to justify authoritarian measures,\u00a0<\/span><\/span><span class=\"hyperlink00\"><span lang=\"EN-US\"><a href=\"https:\/\/newsinfo.inquirer.net\/944204\/dilg-strips-governor-23-mayors-of-power-over-police-for-drug-links-over-police-napolcom-dilg-illegal-drugs-power-over-police\">weaken<\/a><\/span><\/span><span class=\"none0\"><span lang=\"EN-US\">\u00a0civilian authority, and <\/span><\/span><span lang=\"EN-US\"><a href=\"https:\/\/www.theguardian.com\/world\/2017\/mar\/17\/eu-condemns-fabricated-charges-jailed-accuser-philippines-president\"><span>imprison<\/span><\/a><\/span><span class=\"none0\"><span lang=\"EN-US\"> critics such as Senator Leila de Lima, an outspoken opponent of Duterte&#8217;s drug war.\u00a0<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">So have these brutal anti-drug campaigns at least achieved their stated goal of reducing drug markets?\u00a0<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">Data released by the UN Office on Drugs and Crime shows that this is not the case. Despite costly eradication efforts, illicit plant cultivation\u00a0has persisted in most areas, increased (in places like Myanmar) or even skyrocketed (in Afghanistan). Drug use levels have also remained high or even increased. It is estimated that in Asia some\u00a017 million people use amphetamines. In Southeast Asia in particular, amphetamines and ecstasy have been identified as increasingly worrying problem by local authorities, but no reliable data on use is available.\u00a0<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">There has also been a significant increase in seizures of methamphetamine tablets and in cannabis in the region between 2008 and 2015. This, however, does not point to effective interdiction efforts, but to the continued expansion and dynamism of the illicit drug market, despite tremendous law enforcement efforts to curb it.\u00a0As long as there is demand, supply will continue to flourish, albeit in different and increasingly innovative ways.<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">In 2015, some 35 percent of all recorded drug-related deaths worldwide occurred in Asia; there were 66,100 cases, attributed largely to overdose. Fear of punishment or arrest almost always prevents drug users from seeking help, meaning that most people who overdose die a preventable death alone in appalling circumstances.\u00a0<\/span><\/span><\/p>\n<p class=\"body0\"><span class=\"none0\"><span lang=\"EN-US\">Even in the Philippines, where a brutal war on drugs has been raging for almost three years, &#8220;success&#8221; has <\/span><\/span><span class=\"none0\"><span>been<\/span><\/span><span class=\"none0\"><span lang=\"EN-US\"> elusive. While the anti-drugs operations have succeeded in changing public perceptions &#8211; some 66 percent of Filipinos believe there is a decrease of drug use in their area &#8211; it has not managed to shut down the vast drug networks that run through the country. Large shipments of methamphetamines are still making it into the country, with <a href=\"https:\/\/www.philstar.com\/headlines\/2018\/08\/11\/1841547\/shabu-worth-p68-billion-slips-past-customs\"><span>only some of them being intercepted<\/span><\/a> by the police, which means neither supply, nor demand has decreased significantly. <\/span><\/span><\/p>\n<h2 class=\"Body\">\n<span class=\"None\"><span>\u00a0<\/span><\/span><strong><span lang=\"EN-US\">Where do we go from here?<\/span><\/strong><br \/>\n<\/h2>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">A decade on, Asia&#8217;s overreliance on harsh policies and practices has not only failed monumentally to reduce drug supply and demand, but it has also, in fact, had the opposite effect. The region is awash with illicit drugs, while the drug trade is more dynamic than ever before. At the same time, punitive drug policies have created detrimental health, social and economic consequences that are far more harmful than the drugs themselves.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Moving forward, an immediate challenge for the region is to distinguish between the need for evidence-based responses on drug issues and political prescriptions that are rarely effective and often self-serving. This calls for a rethink of the metrics we use to evaluate drug policies.\u00a0<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Instead of the unattainable aspiration of a &#8220;drug-free&#8221; society or the narrow vision of reducing drug markets, states gathering in Vienna next month should develop more\u00a0<\/span><\/span><span class=\"Hyperlink1\"><span lang=\"EN-US\"><a href=\"http:\/\/fileserver.idpc.net\/library\/Shadow_Report_FINAL_ENGLISH.pdf\"><span>meaningful targets<\/span><\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0that reflect the inconvenient realities of such policies on the ground. Such a paradigm shift requires the participation of scholars, civil society groups and people affected by the drug war.\u00a0<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Fortunately, we can find inspiring stories on the continent as well. South Korea&#8217;s\u00a0recent\u00a0<\/span><\/span><span class=\"Hyperlink0\"><span lang=\"FR\"><a href=\"https:\/\/www.ft.com\/content\/ff715088-f2ba-11e8-ae55-df4bf40f9d0d\">legalisation<\/a><\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0of medical cannabis, for instance, can pave the way for re-thinking the role of drugs in society.\u00a0<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Thailand&#8217;s\u00a0<\/span><\/span><span class=\"None\"><span lang=\"IT\">success<\/span><\/span><span class=\"None\"><span lang=\"EN-US\">\u00a0with alternative development programmes,\u00a0which effectively reduced levels of opium crop cultivation and improved the livelihoods of\u00a0farmers, can reframe drug cultivation as a sustainable development challenge. Promising efforts by Indonesia, Myanmar, Thailand and Vietnam to promote\u00a0health-oriented responses to drugs can support a larger role for health authorities rather than law enforcement in drug strategies.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Unless governments give such approaches a chance, there will be no successes to speak of in relation to Asia&#8217;s drug policies in the future. More of the same zero-tolerance strategies are unlikely to yield different results, which is why we must keep pointing out the futility and harms of draconian drug measures, and challenging governments to move away from their &#8220;drug-free&#8221; paradigm.<\/span><\/span><\/p>\n<p class=\"Body\"><span class=\"None\"><span lang=\"EN-US\">Drug policies must no longer be about waging wars but about confronting the realities of expanding drug markets in ways that improve the state of public health, human rights and development.<\/span><\/span><\/p>\n<p class=\"Body\"><strong><span lang=\"EN-US\"><span lang=\"EN-US\"><span lang=\"EN-US\"><em><span lang=\"EN-GB\">The views expressed in this article are the author&#8217;s own and do not necessarily reflect Al Jazeera&#8217;s editorial stance.<\/span><\/em><\/span><\/span><\/span><\/strong><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The war on drugs in Asia has been going on for over a decade now.
